Definitions of Some Terms.

“We”, ”us”, ”our”, ‘’NewConcepts Telecom’’ mean New Concepts Tech Limited (a company established under the Laws of the Republic of Ireland).

“You”, ‘’your”, ”Customer” shall mean the person agreeing to use our services.

“Services” means the telephone, call termination, VoIP or related services to be supplied by us to you in accordance with these Terms and Conditions.
“Account” is the electronic or paper-based mechanism that records a Customer’s details, payments and/or credits to the Account and all charges made to the Customer for using the Service. The Customer signs up to an Account and/or Agreement in applying either through paper-based documentation or electronically.
"Agreement", means these terms and conditions, our tariffs for the Service as amended from time to time, the Customer Application/Registration and/or the Customer Authorisation Form which together constitute a legally binding agreement between the Customer and New Concepts Tech.
“Account Number” is a unique number issued by us to the Customer which will be required for use from time to time. It is the Customer’s responsibility to keep the Account Number confidential.

“Call Charges” are costs per second charged when using the Service and these are subject to change from time to time.

“Website” means our website http://www.newconceptstech.com

Introduction

This Service Terms and Conditions explain the terms upon which we agree to provide the Service and you agree to use our Service. They take effect when the Customer applies for the Service and such
application approved by us through email and/or letter.
To apply for the Service and set up an Account, the Customer must fill in the required sections of the Customer Application/Registration and/or Customer Authorisation Form either as paper-based form or electronically on our Website.
Your application to receive our services shall not be accepted by us unless and until it is confirmed in writing as email and/or letter by us.
Upon receiving and approving your application, we will set you up for the service within 30 days.
We reserve the right to amend this Agreement from time to time and notification of such amendments will be made by posting the revised agreement on this site.

Eligibility

To apply for our Services, you must be at least eighteen (18) years old.
You agree that the details supplied to us at application shall be true, accurate and complete.

You agree that by using this site, you are legally bound by this Agreement. If you do not agree to be legally bound by this Agreement, you should quit this site immediately.

Customer Responsibilities

The Customer is responsible for all usage of the Service that is made on the Customer’s Account. You are responsible for the accuracy, correctness and legality of all the information you supply to us in connection with the use of our service.

You agree that we are not responsible for any claims that may arise from any inaccurate or incomplete information you provide to us.
The Customer must not let the Service be resold, re-supplied or otherwise make the Service available to any person(s) either on a commercial basis or for any purpose prohibited by law.

We will issue an Account and/or Agreement Number to the Customer upon a successful application for the Service. It is the Customer’s responsibility to keep this confidential.
The Customer must maintain a working email address to be used for constant and ongoing communication with us.
The Customer must notify us immediately of any change to the Customer’s name, address and email address to ensure among other things that we have a current and valid means of communicating with the Customer.

It is the Customer’s responsibility to ensure they read the Terms and Conditions on regular basis to update themselves with any revisions/changes.

You agree that your continued use of this service after posting any revision to our Agreement constitutes your consent to be bound by such changes.

It is the Customer’s responsibility to ensure control of access to their service to avoid usage of the Account without the Customer’s permission, as the Customer will be responsible for all calls made on the Account.

The customer will pay before the service is used as this service is prepaid.

The customer may be required in some circumstances to pay an initial deposit otherwise called Security Deposit the amount which will be determined by us before setup for this service is complete. The full amount shall be refunded at the termination or suspension of customer’s use of our service provided there are no outstanding payments due.

The Customer must not let the Service be used to cause annoyance or for anything defamatory, offensive, abusive, racist or obscene.

You will not use the service in a manner which constitutes a violation or infringement of the rights of any person(s) or group(s).

You will not use the service in any other way that is in breach of the relevant Telecommunications Act or Acts, as may be amended from time to time by relevant authorities/agencies.
You will comply with any reasonable instructions we may give you from time to time relating to use of the Services.

Failure to top up or credit your account will result in discontinuation of your service.

Customer accepts responsibility for the non-workability and non-compatibility of any hardware with our system and no guarantee is made that such hardware(s) will work with our service.

We may suspend the use of the Service without prior notice if we know or have reasonable grounds to suspect that misuse or abuse of the Service is occurring. We have the right to terminate the service in these instances.

You agree to indemnify us to the fullest extent possible against any claims, losses, damages, costs, liabilities and expenses (including legal costs) which we may incur as a result of your (a) use of our services (b) violation of the Terms and Conditions (c) violation of any rights of another person(s) or group(s).

Permitted Use

We grant you a non-exclusive, limited and non-transferable access and use of this service subject to our Terms and Conditions.

Cancellation/Refund


Customers may cancel their services with us at anytime without prior notice.

We reserve the right to cancel our services to you in cases where your use of our services is in breach of our Terms and Conditions.

Our services are purely prepaid and we do not offer post-paid services to any customer. Once PINs are loaded to customers account, no refund shall be made.

Once customers recharge accounts through credit cards, no refund shall be made.

We will fix any technical issues arising from difficulties with PINs loading as quickly as possible.

Service Provision

Our services work via broadband and as such the quality of the telephone services are dependent on the quality of the customer's broadband internet connection, and thus the quality of the voice services cannot be guaranteed in the event of power outages, or other unforeseen circumstances beyond our control.

We will endeavour to ensure that the service provided is qualitative and reliable, we make no guarantee that service will be available on 24hours non-stop basis.

Emergency Calls

It is the responsibility of the customer to describe their exact physical locations to emergency services operatives because of the way VoIP telephony services work. Physical location of users cannot easily be determined, hence customers should always bear this in mind.

Customers must note that the reliability of our service/calls cannot be guaranteed to Emergency services especially in times of adverse occurrences which may affect electronic systems like computers and other relevant equipment. Customers are advised to always have a backup method of making emergency calls at all times.

Confidentiality

Calls through our system are carried over the internet (in the public domain). The security of these calls cannot be guaranteed. Hence customers are advised to consider additional security measures they may deem fit. We will endeavour to use appropriate security measures but accepts no liability with respect to call confidentiality.

Charges

All Call Charges are exclusive of VAT (except otherwise stated) at the prevailing rate in the Republic of Ireland.
Call charges are on per second basis.

Rates

Our rates are in Euros. We can make US Dollars rates available on request. Rates vary from time to time according to market trend. Rates are reviewed every two weeks.We reserve the right to change rates at any time without notice. The rate applied to your account after signup and payment is the latest prevailing rate.

Payment Methods

We accept the following methods of payment for our services: bank transfer, credit card, Western Union and Money Gram.

Warranties and Limitation of Liability


We will use all reasonable skill and care to ensure the Services are of a satisfactory quality and correct any failures of the Services on becoming aware of them as soon as reasonably practicable.

You will inform us promptly of any failure or defects and afford us a reasonable period of time to correct any such failure or defect.

We make no warranty, express or implied, that the Services will be wholly uninterrupted or problem-free or that our ability to supply the Services will be wholly unaffected by capacity constraints.

You agree that under no circumstances shall we be liable for any damages such as but not limited to loss of revenues or savings, that may arise from your use of this service.
All other express or implied terms, conditions or warranties (whether statutory or otherwise) are hereby excluded to the fullest extent permitted by law. The provisions of this Agreement shall continue in full force and effect after the contract is terminated.

Indemnification

You agree to indemnify and hold us harmless from and against any failure, losses, damages, expenses that may arise from your use of our service.

We will not be liable for any failure of performance of the Services for reasons beyond our reasonable control, including (but not limited to) default of a third party, acts of God, severe weather, failure or shortage of power supplies, flood, drought, lightning or fire, strike, lock-out, trade dispute or labour disturbance, malicious damage, explosion, riot or civil commotion, the acts or omissions of governments or other authorities or other competent authorities, or other events of force majeure.

Disputes


We will try to resolve any disputes that you may have with us as promptly as possible. If for any reason you encounter a problem with our service, you may contact us in writing as in letter and/or email in order to identify and resolve the issue.

You can also contact Communication Regulation of Ireland (COMREG) in cases where you are not happy with our handling of your concerns.

Privacy Policy

We will use the information you provide to us in association with the Service to manage your relationship with us and the provision of the Service to you, to enable us to understand your usage of the Service in order to improve our Service, and to contact you in writing, through email or by phone with information about the Service. We also assess usage information in order to prevent and detect fraud. Information may be shared with our affiliate partners so that we may better serve your needs. By applying to have an Account and use the Service you consent to receiving information from time to time about our products and/or services which we believe may be relevant to you.

Communications

Our communications with you will primarily be based uponemail and/or letters.

General

This Agreement shall be governed in accordance with Irish law and the parties hereby submit to the exclusive jurisdiction of the Irish Courts.

Each part of this Agreement operates separately. If any part is disallowed, or is not effective, the other parts will continue to apply.
